1. General Information

These Terms and Conditions govern the use of the HERBARISE online store and the purchase of products through https://herbarise.com/en.

Hereinafter referred to as “HERBARISE”, “the Seller”, “we”, “us”, or “our”.

These Terms and Conditions apply to orders placed through the HERBARISE online store.

Nothing in these Terms and Conditions limits or excludes mandatory consumer rights under applicable European Union or national legislation.

2. Definitions

Customer: Any individual or legal entity placing an order through the website.

Consumer: A natural person purchasing products for purposes outside their trade, business, craft, or profession.

Products: Food supplements, cosmetic products, and other goods offered through the HERBARISE online store.

Order: A purchase request submitted through the website.

Contract: A distance sales agreement concluded between the Customer and the Seller following acceptance of an order.

Business Day: Monday to Friday, excluding public holidays in Bulgaria.

3. Products and Product Information

HERBARISE offers natural food supplements and related beauty and wellness products.

Each product page provides relevant information about the product, including its characteristics, ingredients, quantity, intended use, price, and availability. We make reasonable efforts to ensure that all product information is accurate, complete, and up to date. Product packaging or appearance may occasionally differ from the images displayed on the website, provided that the essential characteristics of the product remain unchanged. Customers should carefully read product labels, instructions, and warnings before use. Food supplements are not intended to replace a varied and balanced diet or a healthy lifestyle. Information published on the website is provided for general informational purposes and does not constitute personalised medical advice.

4. Prices, Taxes and Availability

All product prices on the HERBARISE online store are displayed in euros (EUR) unless otherwise indicated.

Prices include applicable Value Added Tax (VAT), where required by law.

Any applicable delivery charges are displayed before the Customer confirms the order.

Promotional prices, discount codes, and special offers are subject to the conditions published for the relevant promotion.

Product availability is updated regularly.

If an ordered product becomes unavailable, HERBARISE will notify the Customer and offer an appropriate solution, such as an agreed alternative or a refund.

We reserve the right to correct obvious pricing or technical errors. Any changes to an accepted order require the Customer’s agreement.

5. Ordering and Contract Formation

Customers can place orders through the following process:

Select the desired products.
Add the products to the shopping cart.
Enter the required billing and delivery information.
Select an available delivery and payment method.
Review the order details and total price.
Confirm and submit the order.

Before completing the purchase, Customers have the opportunity to review and correct their information.

After an order is submitted, an automated confirmation email is sent to acknowledge receipt.

The sales contract is concluded when HERBARISE sends an email expressly confirming acceptance of the order.

We may decline an order for legitimate reasons, including product unavailability, suspected fraud, delivery restrictions, or obvious pricing errors.

If payment has already been collected for an order that cannot be accepted, the relevant amount will be refunded without undue delay.

6. Payment Methods

HERBARISE accepts the payment methods made available during checkout.

Depending on the delivery destination, available options may include:

Credit or debit card

Digital wallet payments

Bank transfer

Cash on delivery, where supported

The available payment methods are displayed before the Customer confirms the order.

Electronic payments are processed through the relevant payment service providers using appropriate security measures.

The total payable amount, including applicable taxes and shipping charges, is displayed before order submission.

HERBARISE does not request payment card security codes through email or customer support communications.

7. Order Processing and Delivery

Orders placed before 14:00 Bulgarian local time (EET/EEST) on Business Days are normally processed and dispatched on the same day, subject to availability and operational conditions.

Orders placed after 14:00, during weekends, or on Bulgarian public holidays are normally processed on the next Business Day.

HERBARISE ships to supported destinations within the European Union using DPD and selected local courier services.

The estimated delivery time is 3–5 Business Days from dispatch.

Free standard shipping is available for orders over €60. For orders of €60 or less, applicable delivery charges are displayed during checkout.

Once an order has been dispatched, tracking information is provided to the Customer.

If we become aware of a significant delivery delay, we will contact the Customer and provide an update.

The risk of loss or damage generally remains with the Seller until the Customer, or a designated third party other than the carrier, takes physical possession of the goods. Different statutory rules may apply where the Customer independently commissions a carrier not offered by the Seller.

Delivery estimates do not affect the Customer’s statutory rights relating to delayed or failed delivery.

8. Order Cancellation and Right of Withdrawal

Customers may request cancellation of an order before dispatch by contacting HERBARISE.

Consumers purchasing through the online store generally have the right to withdraw from the sales contract within 14 calendar days after receiving the goods, without providing a reason.

To exercise this right, the Consumer must notify HERBARISE of their decision before the withdrawal period expires.

Following withdrawal, the Consumer must return the goods within 14 days of notifying the Seller.

The direct cost of returning goods following a change of mind is borne by the Consumer, unless otherwise agreed or required by law.

The Seller will reimburse the relevant payments, including standard outbound delivery charges where legally required, within 14 days of receiving the withdrawal notification.

Reimbursement may be withheld until the returned goods are received or evidence of their dispatch is provided, whichever occurs first.

Refunds are made using the original payment method unless expressly agreed otherwise.

Certain statutory exceptions may apply, including sealed goods unsuitable for return for health protection or hygiene reasons once unsealed after delivery, where the legal conditions for that exception are satisfied.

The Consumer may be responsible for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

9. Defective Products and Legal Guarantee

Consumers benefit from statutory rights when goods are defective, damaged, incorrectly supplied, or otherwise do not conform to the sales contract.

Under EU consumer protection rules, a minimum two-year legal guarantee generally applies to consumer goods, subject to applicable national legislation and relevant legal provisions.

Depending on the circumstances, the Consumer may be entitled to repair or replacement where appropriate, a proportionate price reduction, or termination of the contract.

Where the Seller is legally responsible for non-conforming goods, statutory remedies are provided without unlawful charges to the Consumer.

These rights are separate from the 14-day right of withdrawal.

10. Privacy and Personal Data

HERBARISE processes personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).

Personal data may be processed for order fulfilment, payment administration, delivery coordination, customer support, legal compliance, and other purposes supported by an appropriate legal basis.

Marketing communications are sent in accordance with applicable consent and electronic marketing requirements.

Customers may withdraw marketing consent where applicable.

11. Intellectual Property

12. Acceptable Website Use

Users agree not to use the website for unlawful, fraudulent, or harmful activities.

Prohibited activities include:

14. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the Republic of Bulgaria.

Where a Consumer resides in another EU Member State, this choice of law does not deprive the Consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence, where applicable.

In the event of a complaint or dispute, Customers are encouraged to contact HERBARISE first.

Consumers may also seek assistance from competent consumer protection authorities or appropriate alternative dispute resolution bodies.

Any court proceedings will be subject to the applicable rules on jurisdiction, including relevant EU consumer protection provisions.

15. Changes to These Terms and Conditions

HERBARISE may update these Terms and Conditions to reflect changes in legislation, business operations, or website functionality.

The current version will be published on the website with its effective date.

Changes will not retroactively remove statutory rights or alter existing contractual obligations without a valid legal basis.
